Mediation Compared To Litigation Litigation is a costly, stressful, time consuming, highly formal method of resolving disputes. In litigation, as opposed to making an agreement, a Judge or Jury makes its ruling deciding the result of your case. Whether the decision is what you wanted or not wanted, you are required to live by the decision of the court. In contrast, mediation is an informal, voluntary process where an impartial person, trained in facilitation and negotiation techniques, assists the parties in making a mutually acceptable resolution to their dispute. In contrast to litigation and arbitration, the mediator does not impose a solution but rather works with the parties to create their own solution.
