Mediation Compared To Litigation
Litigation is a costly, stressful, time consuming, highly formal method of resolving
disputes.  In litigation, as opposed to making an agreement, a Judge or Jury makes
its ruling deciding the result of your case.  Whether the decision is what you wanted
or not wanted, you are required to live by the decision of the court.

In contrast, mediation is an informal, voluntary process where an  impartial person,
trained in facilitation and negotiation techniques, assists the parties in making a
mutually acceptable resolution to their dispute.  In contrast to litigation and
arbitration, the mediator does not impose a solution but rather works with the
parties to create their own solution.

An Overview Of Mediation
Mediation is a flexible and creative process where the mediator is trained to utilize
techniques to facilitate a mutually accepted agreement between the parties.  In most
cases the parties meet to discuss the issues face to face, however, the mediator
may hold private caucuses with each party separately.  In these private caucuses
the mediator will transmit messages to the other party, clarify issues, questions,
offers, proposals, and counter-offers between the parties.     

It is important to note that mediation is not binding.  The goal is to get to a solution
satisfactory to all parties.  However, if the parties are unable to come to an
acceptable agreement, mediation may still provide the benefit of narrowing the
issues to be litigated saving time and money in the litigation process.
